Welcome to our website which is operated by Diabetes New Zealand Supplies a wholly owned subsidy of Diabetes New Zealand. By using this website and purchasing products from us you are agreeing to these terms and conditions which may be changed at any time by us updating this site. Please read these terms carefully. They are designed to help you in using the site, to set out our respective rights and obligations and generally to make your shopping experience with us a pleasant one.
The Products which we sell
We sell a wide range of prescription and non-prescription pharmaceuticals and health-care products from this site. They are all pre-packaged with manufacturers' warranties and directions for use. The site also contains explanatory material about many of the products to inform you and help you in your buying decision. However, that information is not a recommendation nor is it a substitute for the advice given by your own medical advisers. You must not use the general information on this site to diagnose or treat a health problem or disease. Read all the product information carefully before you purchase a product. If you are unsure or suspect that you have a medical problem consult your health professional immediately.
You - the buyer of our products
This site can be accessed outside New Zealand but it is designed primarily for New Zealand users. If you are outside New Zealand we welcome you but note that your use of the site and the purchase of products are subject to New Zealand law and the exclusive jurisdiction of the New Zealand courts.

How you buy products from us
Browse through the site, read the information, note the price and delivery terms and then follow the instructions for purchase.
By clicking the send button you will have ordered the product and once confirmed by us you will have formed a contract with us. If for any reason we consider that your order does not fall within our policies from time to time (for example, we do not supply product ordered for subsequent resale or in quantities which may place us in breach of New Zealand ethical, or governmental directives or guidelines) we will not confirm your order and we will not process your nominated payment authority.
Our confirmation of your order creates a contract between us. You will have authorised us to charge one of your nominated payment authorities. Once you have ordered the product the payment cannot be reversed. Note that if you pay by cheque your order will not be processed and the products will not be sent to you until such time as your cheque is cleared. However, you will still have a contract with us on the terms and price prevailing at the time of the confirmation of your order.
Product range
We can revise or discontinue our product range at any time. If you place an order and we are out of stock we will contact you as soon as possible and offer a later delivery time, a suitable replacement or a credit for other purchases from our site, or refund the full amount of the transaction.
Price
Before you place the order read the price carefully. Note the currency (usually in New Zealand Dollars). If you are ordering from overseas check the exchange rate. Our price to you is the price on the site at the time you place your order. In New Zealand, the price will include Goods and Services Tax (GST or value added tax). For orders outside New Zealand our prices exclude New Zealand GST (presently 15%) but they do not include any import fees, duties, tariffs or other charges associated with importation and delivery to your country. They are your responsibility.
Delivery
The products will be delivered to you at our own cost (inclusive in the price for the products) and by such route as we consider most efficient.
For delivery in New Zealand deliveries will usually be by normal post or courier. Deliveries outside New Zealand will usually be by air-freight.
Note the indicative delivery times on the site. They may alter depending on the carrier. For bulky, heavy or large orders we reserve the right to deliver by different methods.
When we specify a delivery date and method in our confirmation of order we will do our best to deliver the products to you by that date and method.
However, please note that delivery is the responsibility of independent agencies and the type or amount of products may affect normal delivery processes. Accordingly, we are not responsible to you if the delay in delivering is because of causes outside our control or those agencies cannot deliver to you. Depending upon the number of items in your order we may deliver in quantities and instalments decided upon by us. Each delivery will be a separate contract under these terms and conditions.
Risk
The products are at our risk once they are placed with the delivery agency. Once they have been delivered to the address nominated in your order they are at your risk.
Our product promises to you
In most cases, our products will contain extensive manufacturers' warranties and guarantees giving you rights in respect of defective products. In addition, if you use our site you are promising to us that you are doing so as a consumer (that is, you are purchasing the products for personal, domestic or household use or consumption). As a consumer the sale of the products is subject to the New Zealand Consumer Guarantees Act 1993. For more information about this Act go to the Ministry of Consumer Affairs website http://www.consumeraffairs.govt.nz/
Under that Act our promise to you is to provide products which are of acceptable quality (determined by what the product is, the manufacturer's description and directions for use of the product, and its price). You should read the manufacturer's directions for use carefully. The product is not defective if you do not use it in the required way. There may also be relevant "use by" or expiry dates.
If the product is defective (not of acceptable quality) you have the right to return it to us within a reasonable period of time after purchase. We will replace the product with either the same product if available or a product which is a reasonable equivalent. If that is impossible, at your option, we will give you a credit for other purchases from this site or a refund. You also may also have rights against the manufacturer under its warranties.
Product returns
If the product is defective or has not been delivered correctly to you (such as-wrong product, wrong quantity, damaged packaging or contents) then you have the right to return it to us subject to the following policies. Please read them carefully.
If the products have been delivered satisfactorily but are not of acceptable quality (defective) contact us immediately on admin@diabetes.org.nz citing an order number or on +64 4 4997145 . If calling from outside New Zealand note any time and date differences.
If the products are damaged in delivery advise both us (using the same details above) and the delivery agency immediately. Their details will generally be on the delivery pack. You must keep the delivery package for 60 days to provide information on the reasons for defective delivery.
In the case of defective products, whether because of defects or because of delivery, when we have been notified by you in accordance with this product returns policy and have determined that the products are defective we will honour our product promise to you (replacement, refund or credit as explained above).
In the case of defective delivery you must cooperate with all inquiries and any claim we or the delivery agency make for compensation as a result of that delivery.
In either case, the products must be returned in their original or "as delivered" condition and packaging together with any accessories, instructions, warranty card, invoice or packing slip. You are responsible for the safe and secure return of the products to us. Wrap all the items in the original box or packaging and send to us at Diabetes Auckland Valley Road MT Eden , New Zealand. Proof of posting is not receipt - we suggest that you return products by the same delivery method by which you received them.
So that we can deal with the return promptly you must provide us with the reason for your return of the products such as a product defect or a failure of delivery, in each case with supporting evidence or information. Please note that your change of mind is not a valid reason to return products.
Privacy policy
When you use this site you are providing us with personal information about yourself.
We collect that personal information in order to help us improve the site, our product range and sales processes and improve your personal shopping experience with us, including marketing and promotion. We make that information available to our business partners or as required by New Zealand governmental health authorities for administrative or research purposes. We will not provide your personal information to third party suppliers for marketing or sales purposes without your permission.
We will store your personal information securely. You can view and update it at any time by logging in with your username and password.
Electronic communications
From time to time, we may contact you electronically (email, text or other) concerning this site or product promotions. By using this site you will be deemed to have given your permission to those communications which will have an unsubscribe facility in accordance with the Unsolicited Electronic Messages Act 2007 (anti-spam legislation). Please also note the provisions of section 11 of the New Zealand Electronic Transactions Act 2002: an email is deemed received by us only when it comes to our attention.
